Benefit prospective Penalty is not

Kolkata GSTAT holds that Notification No.14/2022 excluding duty credit scrips from exempt turnover for ITC reversal operates prospectively from 5 July 2022 and cannot benefit FY 2017–20 transactions.

However, the Tribunal draws a clear line between a wrong legal position and deliberate suppression, noting that the scrip transactions were fully disclosed.
