This document is an electronic record in terms of Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the and Terms of Use for access or usage of justidt.com or any of its apps.   

The Application (defined below) is owned by Justidt Solutions Private Limited a company incorporated under the Companies Act, 2013 and having its registered office at  6/3/1090/1/0/LT/103, Tulips Legend, Off Raja Bhavan Road, Somajiguda, Hyderabad. (hereinafter referred to as “Company”).

Please read the conditions contained herein carefully before using the software application namely JustIDT(“Application”) for mobile devices that was created by Justidt Solutions Private Limited. By accessing or using the services and tools on the Application (collectively the “Services”), however accessed, you agree to be governed and bound by the following terms and conditions (“Terms of Use”) as applicable to the Services including the applicable policies which are incorporated herein by way of reference. If you use the Application, you shall be subject to the policies that are applicable to the Services for such transaction. By mere use of the Services, you shall be contracting with by Justidt Solutions Private Limited   and these terms and conditions including the policies constitute your binding obligations, with Justidt Solutions Private Limited These Terms of Use affect your legal rights and obligations. If you do not agree to be bound by all of these Terms of Use, do not access or use the Services.

There may be times when we offer a special feature that has its own terms and conditions that apply in addition to these Terms of Use. In those cases, if there is any conflict between the terms specific to the special feature and these Terms of Use, then such special terms shall override these Terms of Use.

For the purpose of these Terms of Use, wherever the context so requires ‘You’ or “User” shall mean any natural or legal person who has agreed to become a member of the Services by providing Access Credentials (defined below) while registering on the Services as Registered User using the computer systems or mobile phones. The Company does not allow Users to surf the Services or make purchases without registering on the Services. The term “we”, “us”, “our” shall mean Justidt Solutions Private Limited

ACCESSING, BROWSING OR OTHERWISE USING THE APPLICATION INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING. 

ARBITRATION NOTICE: EXCEPT IF YOU OPT-OUT AND EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN THE ARBITRATION SECTION BELOW, YOU AGREE THAT DISPUTES BETWEEN YOU AND Justidt Solutions Private Limited  WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. 


Basic Terms

1. Use of the Application is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. If you are a minor (i.e., under the age of 18 years, you shall not register as a member of JustIDT and shall not transact or use Services). As a minor if you wish to use or transact on Services, such use or transaction may be made by your legal guardian or parents on the Services. The Company reserves the right to terminate your membership and/or refuse to provide you with access to the Services if it is brought our notice or if it is discovered that you are under the age of 18 years.

2. By using the Services, you shall be responsible for maintaining the confidentiality of your Login Name and Password or your access credentials whatever they may be (“Access Credentials”), and you shall be responsible for all activities that occur under your Access Credentials. You agree that if any information provided by you that is inconsistent, inaccurate, not current or incomplete.

3. You are solely responsible for your conduct and any data, text, files, information, graphics, user interfaces, visual interfaces, Access Credentials, images, graphics, photos, profiles, of authorship, and other content or materials (collectively, “Content(s)”) that you submit, post or display on or via the Services on the Application.

4. Notwithstanding the provisions in Clause 3 above, You agree, undertake and confirm that your use of Services shall be strictly governed by the following binding principles:

  • Any Content that You post shall not host, display, upload, modify, publish, transmit, update or share any information which:
  • belongs to another person and to which you do not have any right to;
  • is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to “indecent representation of women” within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
  • is misleading in any way;
  • is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;
  • harasses or advocates harassment of another person;
  • promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
  • infringes upon or violates any third party’s rights [including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person’s name, email address, physical address or phone number) or rights of publicity];
  • harm minors in any way;
  • infringes any patent, trademark, copyright or other proprietary rights or  third party’s trade secrets or rights of publicity or privacy or shall not be fraudulent;
  • violates any law for the time being in force;
  • or menacing in nature;
  • impersonate another person;
  • shall not be false, inaccurate or misleading.
  • Shall not post any Content outside the subject of indirect taxation on the discussion forums within the Application.
  • shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time.

5. You fully understand and agree that the Application and its Services are for knowledge-sharing purposes and agree not to use, copy, reproduce, distribute, sell, resell, publish, broadcast, display, cite or exploit the Contents of the Application for any purpose which may include but is not limited to citing the Contents as precedents or using the same in tax proceedings.

6. Violation of these Terms of Use may, in the Company’s sole discretion, result in termination of your JustIDT account. You understand and agree that the Company cannot and will not be responsible for the Content posted on the Service and you use the Service at your own risk. If you violate the letter or spirit of these Terms of Use, or otherwise create risk or possible legal exposure for the Company, we can stop providing all or part of the Service to you.

7. The Services on the Application are part of a paid service and the payments made by the User shall be as part of onboarding of the User account on the Application. Before any fees are paid, the User will have an opportunity to review and accept the fees that will be charged. All fees paid once paid by the User are non-refundable. While availing any of the payment methods available in the Application, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You.

8. You release and indemnify the Company and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions of the users of the Services and categorically waive any claims that you may have pursuant to this under any applicable law. Notwithstanding its reasonable efforts in that behalf, the Company cannot take responsibility for or control the information provided by other users which is made available on the Services. IN NO EVENT WILL THE COMPANY’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES OR CAUSES OR ACTION EXCEED ONE HUNDRED INDIAN RUPEES (INR100.00).

9. We reserve the right to modify or terminate the Service or your access to the Service for any reason, without notice, at any time, and without liability to you. You can deactivate your account by uninstalling the Application following normal application uninstall processes from your phone. If we terminate your access to the Services or you deactivate your account, your posts, cards, comments, likes, ratings, and all other data will no longer be accessible through your account (e.g., users will not be able to navigate to your Access Credentials and view your photos), but those materials and data may persist and appear within the Service (e.g., if your Content has been reshared by others). Further, we reserve the right to force forfeiture of any Access Credentials for any reason.

10. Upon termination, all the rights granted to you in these Terms of Use will immediately cease. Without limiting other remedies, we may limit your activity, immediately remove your information, warn other users of your actions, immediately temporarily/indefinitely suspend or terminate or block your membership, and/or refuse to provide you with access to the Services.

11. We may, but have no obligation to, remove, edit, block, and/or monitor Content or accounts containing Content that we determine in our sole discretion violates these Terms of Use.

12. You represent and warrant that: (i) you own the Content posted by you on or through the Services or otherwise have the right to grant the rights and licenses set forth in these Terms of Use; (ii) the posting and use of your Content on or through the Services does not violate, misappropriate or infringe on the rights of any third party, including, without limitation, privacy rights, publicity rights, copyrights, trademark and/or other intellectual property rights; (iii) you agree to pay for all royalties, fees, and any other monies owed by reason of Content you post on or through the Services; and (iv) you have the legal right and capacity to enter into these Terms of Use in your jurisdiction.

13. We will not be liable for any use or disclosure of Content. You acknowledge and agree that your decision to submit any Content on the Application does not place the Company in a position that is any different from the position held by members of the general public, including with regard to your Content. None of your Content will be subject to any obligation of confidence on the part of the Company and the same is meant for knowledge sharing purposes, and the Company will not be liable for any use or disclosure of any Content you provide.

14. We depend heavily upon Users to let us know about Content that may violate our policies. After we are notified of a potential policy violation, we may review the content and take action, including restricting access to the content, removing the content, refusing to print the content and limiting or terminating a User’s access to the Application. Note that we may make exceptions to these policies based on artistic, educational, or documentary considerations, or when there are other substantial benefits to the public from not taking action. We may also remove content that violates applicable local laws. To report content that You believe should be removed based on local laws or In case you feel that your work has been copied in any way that constitutes copyright infringement or any violation of your IP rights, please write to inquiry@justidt.com

15. This Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Bangalore.

16. All disputes between you and the Company (whether or not such dispute involves a third party) with regard to your relationship with the Company, including without limitation disputes related to these Terms of Use will be resolved by binding, individual arbitration governed by the Indian Arbitration and Conciliation Act, 1996, with the arbitration venue always being in Bangalore, India. Judgment on the award rendered by the arbitrator may be entered in any court having competent jurisdiction. Any provision of applicable law notwithstanding, the arbitrator will not have authority to award damages, remedies or awards that conflict with these Terms of Use. This arbitration agreement will survive the termination of your relationship with the Company.

17. You agree that any claim you may have arising out of or related to your relationship with the Company must be filed within six (6) months after such claim arose; otherwise, your claim is permanently barred.

18. If you are using the Services on behalf of a legal entity, you represent that you are authorized to enter into an agreement on behalf of that legal entity. These Terms of Use constitute the entire agreement between you and the Company and governs your use of the Services, superseding any prior agreements between you and the Company. You will not assign the Terms of Use or assign any rights or delegate any obligations hereunder, in whole or in part, whether voluntarily or by operation of law, without the prior written consent of the Company. Any purported assignment or delegation by you without the appropriate prior written consent of the Company will be null and void. the Company may assign these Terms of Use or any rights hereunder without your consent. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid or otherwise unenforceable, the parties nevertheless agree that such portion will be deemed severable from these Terms of Use and will not affect the validity and enforceability of the remaining provisions, and the remaining provisions of the Terms of Use remain in full force and effect. Neither the course of conduct between the parties nor trade practice will act to modify the Terms of Use. These Terms of Use do not confer any third-party beneficiary rights.

18. We reserve the right, in our sole discretion, to change these Terms of Use (“Updated Terms”) from time to time. Unless we make a change for legal or administrative reasons, we will provide reasonable advance notice before the Updated Terms become effective. You agree that we may notify you of the Updated Terms by posting them on the Services, and that your use of the Services after the effective date of the Updated Terms (or engaging in such other conduct as we may reasonably specify) constitutes your agreement to the Updated Terms. Therefore, you should review these Terms of Use and any Updated Terms before using the Services. The Updated Terms will be effective as of the time of posting, or such later date as may be specified in the Updated Terms and will apply to your use of the Services from that point forward. These Terms of Use will govern any disputes arising before the effective date of the Updated Terms.
