Bombay HC says GST Appeal Cannot Be Dismissed for Non-Appearance

BA Continuum's refund appeal was dismissed because the appellant did not appear despite three hearing notices. 

Bombay HC held that Section 107 requires the Appellate Authority to determine the appeal on merits and record its reasons; dismissal for non-prosecution is not an available course. The appeal was therefore restored for fresh adjudication.
