Bombay HC says IBC Clean Slate Does Not Extinguish Crystallized Employee Awards

The Court distinguished cases where employee claims were still pending when CIRP commenced from the present case, where the Labour Court had already adjudicated the terminations and awarded compensation years before CIRP. The amounts deposited by the employer pursuant to those Awards therefore represented the employees' crystallized entitlement and could not be treated as an asset available to the new management.
