Calcutta HC refuses to quash FIR

Executive Summary

The Calcutta High Court, by its judgment dated 1 July 2026, dismissed a petition seeking quashing of criminal proceedings initiated against Eraaya Lifespaces Ltd., its directors and key officers. 

The Court held that allegations relating to forged documents, criminal conspiracy and misuse of proceedings before the National Company Law Tribunal (NCLT) disclosed a prima facie case warranting investigation.

Reiterating the settled principles governing the exercise of inherent powers, the Court held that it would be premature to interfere at the investigation stage or assess the correctness of the allegations before evidence is collected.
