Calcutta HC says Brand Name on Invoice Alone Cannot Deny Exemption

Kanchan Oil Industries was denied exemption on Vanaspati because its invoices carried the word “Shiva”. The High Court found that the Department’s own evidence showed that the goods and containers bore no such mark. Since the two conditions in the notification were cumulative, the exemption could not be denied merely because the brand appeared on the invoices.
