Calcutta HC says Gold Becomes Prohibited Goods When Imported Contrary to Restrictions

The Court has clarified that the expression “prohibited goods” under Section 2(33) of the Customs Act extends beyond goods specifically prohibited by a notification under Section 11. Where importation is subject to prohibition or restriction under another law, such as applicable RBI regulations, non-compliant gold can be treated as prohibited goods and attract penalty under Section 112(i).
