CESTAT holds Government Authorisation Does Not Make STPI Services Sovereign

STPI argued that SOFTEX certification and NoCs were statutory functions and the charges collected were therefore outside service tax. 

CESTAT rejected the claim, holding that the charges were consideration for identifiable services to software exporters and were neither compulsory statutory levies nor amounts deposited into the Government Treasury.
