CESTAT holds Overburden Disposal Can Constitute Taxable Service

Northern Core Drilling removed overburden from Jindal Saw's mining area and argued that it had purchased the material and was merely selling it onward. 

CESTAT rejected the arrangement as a camouflage, holding that the sale proceeds represented consideration for the disposal service and that royalty paid to the Government for removal was also taxable.
