CESTAT restores AIFTA Benefit

The CESTAT set aside the denial of preferential customs duty on imports under the India-ASEAN FTA.

The Tribunal held that where an importer produces a valid Certificate of Origin issued by the competent authority in the exporting country, Customs cannot disregard the certificate without undertaking the mandatory retroactive verification process prescribed under the India-ASEAN Preferential Trade Agreement Rules.
