CESTAT says Customs Cannot Replace CIF Value With Upstream FOB Price

IG International imported Royal Gala apples from France on CIF terms, while the French supplier had procured them from Brazil at an identical FOB value. CESTAT held that the upstream transaction was commercially distinct and could not substitute the importer’s CIF transaction value without positive evidence of undervaluation or additional consideration.
