CESTAT says Investigation Deposits Attract Interest from Deposit Date

An amount paid during investigation does not become excise duty merely because it is credited under the duty head or later appropriated in an adjudication order. CESTAT treated the amount as a statutory pre-deposit and directed interest under Section 35FF from the date of deposit to the date of refund.
