CESTAT Sets Aside Central Excise Penalties Despite Delayed Payments

CESTAT Bangalore held that, where the assessee had paid the outstanding cess and applicable interest, the amounts paid could be appropriated and the penalties set aside in the facts of the case. It also relied on the earlier ruling in the assessee’s own case, following judicial precedents that had held Rule 8(3A) unconstitutional.
