Chattisgarh HC Invalid Customs Instruction Cannot Defeat MOOWR Licence

Vedanta Power sought a MOOWR licence for its proposed thermal power plant, but Customs rejected the application by relying on Instruction No.13/2022, principally on the difficulty of applying warehousing controls to electricity. 

The High Court held that the instruction had already been struck down by the Delhi High Court and, since the rejection was based on it, quashed the order and directed fresh consideration within 60 days.
