Cheque Notice Mandatory

The Tripura High Court set aside the conviction under Section 138 of the Negotiable Instruments Act after holding that the statutory demand notice had not been served upon the drawer of the cheque in the manner required by law. 

The Court further observed that the complainant had also failed to satisfactorily establish the financial capacity and source of funds for advancing the alleged loan.
