Customs Appeal Abates on Death

The CESTAT Chennai held that an appeal filed by a sole proprietor abates on the appellant’s death if the legal representative does not seek continuation within the time prescribed under Rule 22 of the CESTAT (Procedure) Rules, 1982.

Relying on the Supreme Court’s ruling in Shabina Abraham, the Tribunal held that tax proceedings cannot continue against a deceased person without statutory authority.
