Delhi HC says GST Liability Can Be Determined Against Legal Representative After Death

Section 93 does not require a show cause notice to have been issued during the deceased person's lifetime. However, the provision does not itself establish the underlying contravention or automatically make the legal representative liable - the Department must still establish the deceased's liability and satisfy the conditions of Section 93, with the representative receiving an effective opportunity of defence.
