Delhi HC upholds that a Customs Broker Cannot Lend His Licence Even to His Own G-Card Holder

Executive Summary

The Customs Broker had allowed his G-card holder to use his licence and dongle for ₹10,000 per month and had filed a Shipping Bill in the name of an exporter who had never authorised him. 

The Court held that these were independent breaches of the CBLR. Verification of the exporter's IEC and GST particulars could not substitute for actual authorisation, and the Broker could not avoid disciplinary liability merely because there was no proof that he knew the consignment contained prohibited goods.
