GSTAT. Unaccounted Stock Does Not Automatically Trigger Confiscation

The Tribunal held that finding unaccounted bricks or coal during an inspection does not, by itself, authorise confiscation under Section 130. The proper officer must determine the tax consequences through Sections 73/74, as applicable. The Tribunal also criticised the Department for pursuing appeals without adequately applying its mind.
