Guarantee triggers CIRP

The National Company Law Tribunal, Ahmedabad Bench, held that insolvency proceedings can be initiated directly against a corporate guarantor upon default without first exhausting remedies against the principal borrower or enforcing the underlying security. 

The Tribunal admitted the Section 7 application and commenced the Corporate Insolvency Resolution Process (CIRP).
