IBC Admission Denied

The Tribunal held that where the core claim is founded on disputed, unsubstantiated, and unrecorded “delayed charges,” the same cannot qualify as an operational debt for the purposes of insolvency initiation. 

It reaffirmed that the IBC is not a forum for adjudicating complex contractual disputes. The absence of contemporaneous accounting evidence and existence of prior dispute led to rejection of the petition.
