IBC on personal guarantor

The Chennai Bench of the NCLT has admitted an insolvency application against a personal guarantor under Section 95 of the Insolvency and Bankruptcy Code, 2016. 

The Bench held that a continuing guarantee can be invoked independently of proceedings against the corporate debtor and that liquidation of the principal borrower does not discharge the guarantor’s liability.
