Interim Moratorium no long applies to Personal Guarantor

The Bombay High Court, by its judgment dated 24 July 2026, held that the amendment inserting Section 96(4) of the Insolvency and Bankruptcy Code operates retroactively and removes the interim moratorium available to personal guarantors of corporate debtors from 26 May 2026 onwards. Consequently, the Court entertained a petition under Section 9 of the Arbitration and Conciliation Act and granted interim protective reliefs against the guarantors.
