Interim Relief Refused

The Calcutta High Court upheld the refusal to grant ad interim injunction in a suit challenging a consent decree, holding that the appellate court cannot fault the trial court's exercise of discretion based on materials that were not available when the impugned order was passed. 

The Court clarified that its observations were confined to the question of interim relief and would not prejudice adjudication of the suit on merits.
