Invalid PSIC no ground for confiscation

The Customs, Excise & Service Tax Appellate Tribunal (CESTAT), Chandigarh, set aside the confiscation, redemption fine and penalties imposed on an importer of Heavy Melting Scrap. 

The Tribunal held that a technical defect in the territorial jurisdiction of the Pre-Shipment Inspection Agency does not render the imported goods "prohibited goods".
