ITAT TDS Order Against a Non-Existing Entity Is Void

EMC IT Solutions had merged with Dell International Services from 1 April 2022, and the Department had been informed of the merger before initiating TDS proceedings. Despite this, the Section 201 order was passed and served in the name of the erstwhile entity. ITAT, following Maruti Suzuki, quashed the order as without jurisdiction.
