J and K HC says Refund Cannot Be Reversed Merely Due to Subsequent Change in Law

The Court applied Sarswati Agro Chemicals and held that a subsequent change in law cannot reopen past decisions that had attained finality. Refund was therefore directed, subject to pending Supreme Court proceedings and an equivalent bank guarantee.
