The Delhi High Court declined to entertain a writ petition seeking a direction to the Insolvency and Bankruptcy Board of India (IBBI) to expedite disciplinary proceedings against a Resolution Professional (RP).
The Court held that although the IBBI and the disciplinary proceedings were located in New Delhi, the dispute was intrinsically connected with insolvency proceedings pending before the NCLT, Bengaluru.
Applying the doctrine of forum conveniens, the Court ruled that the mere location of the decision-making authority in Delhi does not confer an automatic right to invoke the writ jurisdiction of the Delhi High Court when the substantial cause of action arises elsewhere.
