Kar HC says Security deposit cannot cover ITC loss

The Karnataka High Court directed Indian Oil Corporation Ltd. to refund the balance security deposit withheld from a contractor, holding that mere allegations of VAT ITC loss are insufficient. 

The Court ruled that the employer must prove contractual default, actual loss and a contractual entitlement to adjust the security deposit before withholding it.
