Kerala HC says exemplary costs by NCLT unwarranted

The Court held that although the NCLT was justified in rejecting a withdrawal application filed under the wrong provision and without CoC approval, its adverse observations and ₹1 lakh exemplary costs were unwarranted. Filing defects ought to have been identified and rectified at the Registry/filing stage.
