Madras HC says Unconstitutional Luxury Tax Must Be Refunded Without Unjust Enrichment

NAC Jewellery was assessed to luxury tax on jewellery for 2002-03 to 2004-05. Following Godfrey Phillips, the levy was no longer sustainable, and the Madras High Court directed refund after the Department confirmed that the tax had not been passed on to customers.
