NCLAT rejects Section 7 Petition as time barred

The NCLAT, Principal Bench, New Delhi, by its judgment dated 17 July 2026, dismissed an appeal against rejection of a Section 7 application. The Appellate Tribunal held that the existence of a financial debt alone is insufficient to trigger insolvency proceedings and that a creditor must establish a definite date of default within the prescribed limitation period.
