NCLT admits CIRP against Corporate Guarantor

Executive Summary
The National Company Law Tribunal (NCLT) held that a guarantor’s liability is co-extensive with that of the principal borrower under Section 128 of the Indian Contract Act, 1872.
It ruled that a financial creditor need not first proceed against the borrower or realise secured assets before initiating insolvency proceedings against the guarantor.
