In a striking development that would support Principle of Natural Justice and India Inc., the Madras High Court’s ruling in Neeyamo Enterprise Solutions Pvt. Ltd. is a watershed moment in GST jurisprudence. For the first time, the Court has categorically held that when Section 74 is invoked without alleging fraud, suppression, or wilful misstatement, the proceedings are void and cannot be remanded.
By quashing both SCNs and orders outright, the Court has sent a powerful signal: jurisdictional defects cannot be “fixed later.”
