On Retrospective ITC Relief Karnataka High Court Reopens Assessment

The Karnataka High Court held that an assessment denying ITC for delayed filing of returns required reconsideration in light of retrospectively inserted Section 16(5). Since the returns were filed before 30 November 2021, the Court quashed the adjudication order and directed the Department to pass a formal order after reconsidering the petitioner’s eligibility.
