Patna HC says Unserved SCN Vitiates an Ex Parte GST Assessment

The Department claimed that the SCN had been uploaded on the GST portal and sent by speed post, but produced only a dispatch-register extract and no tracking or proof of receipt. The Court held that dispatch is not proof of service, set aside the assessment and granted the taxpayer a fresh opportunity to respond and be heard.
