Pre existing dispute and IBC admission

NCLT held that a Section 9 application cannot be defeated by a mere assertion of dispute. The dispute must be real, substantial and supported by evidence. WhatsApp exchanges with an unauthorised family member, without debit notes, claims or proceedings, were insufficient to establish a genuine pre-existing dispute.
