Processing Fee Refund

The Calcutta High Court held that disputes concerning refund of bank processing fees arising from the interpretation of commercial loan sanction documents involve disputed questions of fact that cannot ordinarily be adjudicated in writ jurisdiction. 

While setting aside the Single Judge's direction for full refund, the Court directed payment of 50% of the processing fee, leaving the balance to be decided by the appropriate civil forum.
