Retrospective Import Relief

In a pragmatic and trade-friendly ruling, CESTAT Chennai has reaffirmed that beneficial policy changes must be given retrospective effect where they confer relief without causing prejudice.

The Tribunal allowed imported goods, initially treated as “prohibited”, to be cleared for home consumption in light of a subsequent notification reclassifying them as “restricted.”

The decision underscores a key principle: customs law must align with evolving trade policy realities, especially where legislative intent is to liberalize rather than penalize.
