SC saves turnkey contract from artificial vivisection for taxation

The Supreme Court has delivered a major win for taxpayers, ruling that indivisible turnkey contracts cannot be artificially split to levy service tax. 

Before 1 June 2007, there was no legal authority to tax the installation component of a composite works contract separately.

The judgment reinforces a fundamental principle of tax law: without a clear charging provision, there can be no tax.
