Substantial Questions on Personal Liability

The Bombay High Court has granted interim protection to a Managing Director against coercive recovery proceedings arising from a penalty imposed under Section 122(1A) of the CGST Act.

Noting that the issues raised were already pending consideration in similar writ petitions where interim protection had been granted, the Court restrained the authorities from initiating coercive action until further orders.
