Sugar export ban upheld

Executive Summary

The Bombay High Court has dismissed a batch of writ petitions challenging the DGFT's notification prohibiting sugar exports during the 2025–26 sugar season. The Court held that export policy is an executive function, and where the Government changes policy in larger public interest to safeguard domestic availability of an essential commodity, private commercial contracts, advance remittances and legitimate expectations cannot override such policy decisions. The Court found no arbitrariness, mala fides or violation of Articles 14 or 19(1)(g) of the Constitution.
