Supreme Court holds that a Company Can Be Prosecuted Without Arraigning Its Employees

Sanofi India sought quashing of prosecution on the ground that no employee or officer had been identified or arraigned alongside the company. 

The Supreme Court rejected that proposition and laid down a structured three-stage framework for attributing the acts and state of mind of natural persons to a corporation, holding that the absence of an identified or arraigned individual, by itself, does not defeat prosecution.
